1. Definitions

  • "Services" refer to towing, roadside assistance, vehicle recovery, and any other services provided by Schmitts Auto and Towing.

2. Scope of Services

Schmitts Auto and Towing provides various services, including but not limited to:

  • Vehicle towing (light-duty, medium-duty, and heavy-duty)
  • Roadside assistance (jump-starts, tire changes, fuel delivery, lockout services)
  • Accident recovery
  • Long-distance towing
  • Emergency towing services

All services are subject to availability and the discretion of Schmitts Auto and Towing.


3. Service Requests and Response Time

  • Service requests can be made via phone, website, or mobile app (if applicable).
  • Estimated response times are provided for guidance only and may vary due to traffic, weather, and availability.
  • Schmitts Auto and Towing is not liable for any delays in service provision.
  • Customers should provide accurate location details to ensure prompt service delivery.
  • If the service is delayed or cannot be completed due to the customer providing incorrect information, Schmitts Auto and Towing is not liable for any consequences arising from this.

4. Pricing and Payments

  • Pricing for towing and roadside assistance varies based on the type of service, distance, and other factors.
  • Customers will be provided with a cost estimate before service initiation.
  • Payments can be made via cash, credit/debit cards, or other approved payment methods.
  • All payments are final, and refunds will be considered only under exceptional circumstances at the discretion of Schmitts Auto and Towing.
  • Additional charges may apply for special services, such as after-hours assistance, long-distance towing, or hazardous conditions.
  • Schmitts Auto and Towing reserves the right to revise pricing without prior notice, but any changes will not affect previously confirmed service agreements.

5. Cancellations and Refunds

  • Customers may cancel service requests before a towing vehicle is dispatched without incurring charges.
  • If a service is canceled after dispatch, a cancellation fee may apply.
  • Refund requests must be submitted within 7 days of service completion and will be reviewed case-by-case.
  • If a refund is approved, processing may take up to 14 business days.
  • No refunds will be issued for services that were completed satisfactorily as per the agreed terms.

6. Customer Responsibilities

  • Customers must provide accurate information when requesting services.
  • Customers must ensure their vehicle is accessible for towing.
  • Customers must follow safety guidelines while waiting for assistance.
  • Customers are responsible for securing personal belongings before towing.
  • Schmitts Auto and Towing is not responsible for lost or stolen items left in the vehicle.
  • Customers must ensure they have the legal right to authorize towing for the vehicle in question.
  • Any damages caused by the customer’s failure to follow instructions will not be covered by Schmitts Auto and Towing.

7. Limitation of Liability

  • Schmitts Auto and Towing is not responsible for pre-existing damage to vehicles.
  • We are not liable for losses, damages, or delays caused by circumstances beyond our control (e.g., accidents, road conditions, severe weather).
  • In case of damage caused during towing, customers must report it within 24 hours for investigation.
  • Schmitts Auto and Towing is not responsible for indirect, incidental, or consequential damages arising from the use of our services.
  • Customers agree that any claims made against Schmitts Auto and Towing will be limited to the amount paid for the service in question.

8. Insurance and Claims

  • Customers are responsible for ensuring their vehicle insurance covers towing and roadside assistance.
  • Any damage claims must be supported by clear evidence and submitted in writing.
  • Schmitts Auto and Towing reserves the right to inspect and assess claims before offering any compensation.
  • If a claim is found to be fraudulent or misleading, the customer may be held liable for legal consequences.
  • Customers agree to cooperate fully during the claims investigation process.

9. Prohibited Uses of Our Services

Customers are prohibited from:

  • Providing false or misleading information when requesting service.
  • Interfering with towing operations or engaging in unsafe conduct.
  • Using our services for unlawful activities.
  • Failing to make payment after service completion.
  • Requesting service for a vehicle they do not have legal authority over.
  • Using our services for unauthorized commercial purposes without prior agreement.

10. Privacy and Data Protection

  • Customer information is collected only for service provision and is not shared with third parties without consent.
  • By using our services, you consent to the collection and use of your data in accordance with our Privacy Policy.
  • We implement security measures to protect customer data but cannot guarantee absolute security.
  • Customers have the right to request access, correction, or deletion of their personal data.

11. Dispute Resolution

  • In case of disputes, customers must first contact Schmitts Auto and Towing to seek resolution.
  • If disputes cannot be resolved, they may be escalated through legal means in accordance with the governing laws.
  • Mediation or arbitration may be considered as an alternative to litigation to resolve disputes amicably.

13. Amendments and Updates

Schmitts Auto and Towing reserves the right to modify these Terms and Conditions at any time. Customers are encouraged to review this page periodically.

  • Changes will take effect immediately upon posting unless otherwise stated.
  • Continued use of our services after updates signifies acceptance of the revised terms.

14. Emergency Situations and Force Majeure

  • Schmitts Auto and Towing is not liable for service failures due to force majeure events, including but not limited to natural disasters, acts of terrorism, government actions, or labor strikes.
  • In case of an emergency, customers should contact emergency services (e.g., police, fire department) before seeking towing assistance.

16. Additional Terms

  • If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect.
  • Failure to enforce any part of these terms does not constitute a waiver of our rights.
  • These Terms and Conditions constitute the entire agreement between Schmitts Auto and Towing and its customers, superseding any prior agreements or representations.
